Search and Seizure laws are covered by the 4th Amendment to the Constitution of the United States of America. The 4th Amendment covers unreasonable Searches and Seizures. The important thing to understand is the concept of “unreasonable”. There are a litany of Court Cases that interpret what is “reasonable” as it relates to searches and seizures.
For the most part, the Government needs a warrant to search a person’s home or arrest a person. Such a warrant is generally easily obtained from a Judge or even a Court Commissioner. The Government just needs to show that Probable Cause exists regarding a Criminal Charge to obtain a warrant. Unfortunately, many court decisions have set horrible precedent making it far too easy for the Government to get warrants.
